MINUTES
BOARD OF HEALTH MEETING
THURSDAY, DECEMBER 27, 2007
3:P.M.

II      VARIANCES:



Joyce Bamford           17 Beach Plum Lane      Map-13   Parcel-183

David Lajoie presented a plan that includes secondary treatment which was required by the EBOH on July 26, 2007.  The plan includes secondary treatment with a Micro Fast 0.5 unit. The variances requested are as follows:



1' from leach area to well (Pcl. 208)
2' from leach area to well (Pcl.186)
8' from leach area to well (Pcl. 209)
35' from leach area to well (Locus)
2' from leach area to property line (Pcl.186)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:


Routine water quality test results be provided of existing well location to     assure potability
2.       No increase in design flow be allowed


3.      Secondary treatment and  monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). Nitrate-nitrogen not to exceed 19mg/l. After 2 year period of time reduction of testing  could be requested to BOH by owner.


Operation and maintenance agreement to be submitted to Eastham Board of Health.  Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.


Deed restriction for 3 bedroom use and use of Micro Fast 0.5 unit. alternative technology requirement to be recorded on deed.


6.      Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
7.      Any increase in habitable square footage would require Board of Health review.
8.      Well disclaimer form to be signed by owner.
Dr. Taylor made the motion to approve the plan with the 8 conditions.
Pat Lariviere seconded the motion.

Ed Dumont               4725 State Highway              Map-5   Parcel-130
 
 Chris Wickson submitted plans to upgrade the septic system. The variances     requested are as follows:

Reduction Requested to Title 5 regulations:



5'+/- to the 10' required setback for proposed soil absorption system to (2) lot lines.
        (5'+/-setback proposed to (2) lot lines)

Reduction Requested to Town of Eastham Board of Health Regulations:



17'+/- to the 25' required setback for proposed well to road layout
        (8'+/- setback proposed to road layout)


Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:



No increase in flow allowed
Deed restriction to 3 bedrooms
Well to be tested for VOC and Routine parameters
Well variance form to be signed by owner
Contingent on deep observation hole log to be completed
Dr. Taylor made the motion to approve the plans with the 5 conditions.
Beverly Knox seconded the motion.

VARIANCES CONTINUED:

3.         Robert & Gretchen Robinson   18 Asparagus Rd.        Map-19   Parcel-36

       Stephanie Sequin submitted the plan to upgrade the septic system which  includes secondary treatment with an Advantex AX20 tank which  was required by the BOH on November 29, 2007. The variances requested are as follows:

310 CMR 15.211 Minimum Setback Distances:

The proposed SAS shall be located five feet from a property line where 10 feet is required.  A five-foot variance requested.

The proposed SAS shall be located five feet from a garage slab where 10 feet is required.  A five-foot variance is requested.

The proposed SAS shall be located less than 100 feet from the following wells:
                Parcel 31 - 65 feet, a 35 - foot variance requested.
                Parcel 37 - 65 feet, a 35 - foot variance requested.
                Locus well - 53 feet, a 47 - foot variance requested.

The proposed SAS shall be located 43 ft. from a coastal bank where 50 ft is required.  A seven-foot variance is requested.


The Advantex tank shall be six feet and the pump chamber shall be 12 ft from a coastal bank where 25 ft. is required.  Nineteen and 13 ft. variances are requested.


310 CMR 15.240 Soil Absorption Systems (4)

The SAS’s minimum area for design shall be reduced by 18% (pressure distribution provided)

The SAS shall be 43 feet from the coastal bank on the eastern side of the property and 58 feet from the coastal bank on the western side of the property where 100 feet is required.   57 and 42 - foot variances are requested .

The Advantex tank shall be six feet and the pump chamber shall be 12 ft from a coastal bank where 50 ft. is required .  Forty-four and 38 ft. are variances requested.

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:


Routine water quality test results be provided of existing well location to   assure potability
2.       No increase in design flow be allowed


Secondary treatment with Advantex AX20 treatment to be added to the
Advantex AX20 secondary treatment and monitoring under remedial use approval conditions per DEP regulations including testing quarterly (2 times per year for seasonal use)for total nitrogen ,BOD, TSS and effluent nitrate-nitrogen not to exceed 19mg/l. After 2 years period of time reduction of testing  could be requested to BOH by the owner.

The Chairman read a letter from Bruno & Maria Coppi (abutters to this property) stating their concerns about this project.

 Jason & Raquel Ellis           25 Brittany’s Way           Map-5   Parcel-129C
Jason Ellis submitted a septic system alteration plan with sand filter specifications dated  Dec.1,2007.   Mr. Ellis requested approval to add
1264 sq. ft. office space in the existing garages. Due to nitrogen loading limits of the lot, this would require use of secondary treatment.  Although this will result in additional flow, treatment will reduce nitrogen loading to 25mg/1.

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:



Routine water quality test results be provided of existing well location to    assure potability
2.       No increase in design flow be allowed


3.        Secondary treatment with Recirculating Sand Filter treatment to be added to    the system and   leach area to be expanded


Recirculating Sand Filter secondary (RSF) treatment and monitoring under   general use approval conditions per DEP regulations including testing     quarterly (or 2 times per year for   seasonal use) for total nitrogen, BOD, TSS   and effluent nitrate-nitrogen not to exceed25 mg/l.  After 2 years time   reduction of testing could be requested to BOH by owner.

Operation and maintenance agreement to be required for life of the system.  Operator to   report results via Carmody Data Base provided through Barnstable County Health or directly  to the Eastham Health Department if not available.


Deed restriction for 4 bedroom use and 2,563 sq.ft. office space and use of   RSF secondary treatment to be recorded on deed.   


 Designer to verify proper operation of the system prior to issuance of   Certificate of Compliance.
Any increase in habitable square footage would require Board of Health   review.
Subject to review from Barnstable County Department of Health
 Subject to Planning Board approval
Subject to DEP approval.

Maureen Dooley Lawrence an abutter was present and requested a copy of the plans
and more information about this project.
Pat Lariviere made the motion to approve the project with the 11 conditions.
Beverly Knox seconded the motion.

APPEAL REQUEST


Darien Lennox           50 Spring Tide Lane     Map-17   Parcel-457B

        Jason Ellis representing Ms. Lennox requested the appeal to reverse the
 decision made by the Board of Health January 24, 2000 and resulting  
Board of health order to upgrade the septic system.  The Board of Health acknowledged the existing system designed by Felco Engineering dated 6/10/92 as appropriate for four bedrooms ( 3 bedrooms in the main house plus one bedroom over the garage ).  The septic system will be deemed acceptable providing it pass a Title 5 inspection. The Board also required a deed restriction for 4 bedrooms be recorded at the registry of deeds.
Dr. Taylor made the motion to approve this appeal with title 5 inspection and a deed  restriction for 4 bedrooms recorded at the registry.
Beverly Knox seconded the motion.

REVIEW



6.        Mr.& Mrs.Sanders      75 South Eastham St.    Map-21   Parcel-12

The Sanders submitted a plan for a review to add a garage that will result in side line set back variances.  The Board of Health requested that they return with plans for the variance need to be H-20 loading or able to withstand impact. All variances need to be legally advertised under provision in 310 CMR 15.00.  The original plan for 3 bedroom total septic flow was acknowledged, by Board of Health.



John Fagan              545 Steele Road     Map-4     Parcel-539

The Board approved  Mr. Fagan requests to reduce the number of inspections to the Bio-Microbics Fast system from 4 to 2 times per year if continued to be used only seasonally.
        Pat Lariviere made the motion to approve this request.
        Dr.Ttaylor seconded the motion.
